This DMCA Policy explains how copyright owners may submit a takedown notice, how users may submit a counter-notification, and how we handle repeat infringers.

2. DMCA Takedown Notice Requirements
If you believe that material available on or through the CatchON TV Service infringes upon your copyright, you may send a written notice of copyright infringement to our Designated Agent. To be valid under the DMCA, your notice must include all of the following elements:

Identification of the Copyrighted Work A description of the copyrighted work that you claim has been infringed. If multiple works are covered by a single notice, provide a representative list.

Identification of the Infringing Material A description of the material you claim is infringing and where it is located on the Service. Please include specific URLs or other information sufficient for us to locate the material.

Your Contact Information Your full name, mailing address, telephone number, and email address so that we may contact you regarding your complaint.

Good Faith Statement A statement that you have a good faith belief that the use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.

Accuracy Statement Under Penalty of Perjury A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or are authorised to act on behalf of the copyright owner.

Physical or Electronic Signature A physical or electronic signature of a person authorised to act on behalf of the copyright owner whose right is allegedly infringed.
Notices that do not include all required elements may not receive a response or may be treated as incomplete. We strongly recommend consulting with a legal professional before submitting a DMCA notice.
3. Our Response to Takedown Notices
Upon receiving a complete and valid DMCA takedown notice, we will:
- Promptly review the notice for completeness and validity
- Remove or disable access to the allegedly infringing material where required
- Notify the user who posted the content of the takedown (where applicable)
- Provide the user with a copy of the notice so they may submit a counter-notification if they believe the takedown was made in error
4. Counter-Notification Procedure
If you believe that material was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification to our Designated Agent at help@catchontv1.email. Your counter-notification must include:
- Your full name, physical address, telephone number, and email address
- Identification of the material that was removed or disabled and the location where it appeared before removal
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material
- A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or in the district of New York if your address is outside the United States)
- A statement that you will accept service of process from the party who submitted the original DMCA notice
- Your physical or electronic signature
Upon receiving a valid counter-notification, we will forward it to the original complainant and may reinstate the removed material within 10 to 14 business days, unless the original complainant provides notice that they have filed an action seeking a court order to restrain you from engaging in the allegedly infringing activity.
5. Repeat Infringers
CatchON TV has adopted a policy of terminating, in appropriate circumstances, the accounts of users who are determined to be repeat infringers. We reserve the right to terminate access to the Service for any user about whom we have received multiple valid DMCA takedown notices, or who we reasonably believe to be engaging in repeated or wilful copyright infringement.
This repeat infringer policy is applied at our sole discretion and in accordance with applicable law.
6. Misrepresentation Liability
Under Section 512(f) of the DMCA, any person who knowingly and materially misrepresents that material or activity is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages — including costs and attorneys' fees — incurred by the alleged infringer, the copyright owner, or their licensee, or any service provider who relied on the misrepresentation.
We take misrepresentation very seriously. Please ensure the accuracy of all statements in your DMCA notice or counter-notification before submitting.
7. Good Faith Takedowns
We act in good faith when processing DMCA notices and counter-notifications. We are not liable for any removal or disabling of content that we reasonably believe to be infringing based on a valid DMCA takedown notice, nor for any failure to remove content where a counter-notification has been submitted in accordance with this policy.
8. Changes to This Policy
This DMCA Policy is effective immediately upon posting and may be updated at any time without prior notice. Changes become effective immediately when posted to this page. We encourage you to check this page periodically for any updates.
